Terms of Service

These Terms of Service ("Terms") govern your use of Photizy ("the Service"), operated by Yeah Works, Unipessoal Lda ("Yeah Works", "we", "us"), a company registered in Portugal. By creating an account you agree to these Terms.

1. The Service

Photizy lets photographers upload photo collections, share them with clients through private links, collect client selections, and sell digital downloads and prints. The Service is provided "as is" and we may change or improve features over time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity on your account. You must be at least 18 years old and use the Service for lawful business purposes.

3. Subscriptions and billing

New accounts start with a free trial (15 days, no card required). Continued use requires a paid plan, billed in advance through our payment provider, Stripe. Prices include Portuguese VAT where applicable. You can change or cancel your plan at any time in the billing portal; cancellation takes effect at the end of the paid period. Storage allowances depend on your plan — exceeding them pauses new uploads but never takes existing galleries offline. Fees already paid are non-refundable except where required by law.

4. Your content

You keep all rights to the photos you upload. You grant us the technical licence needed to operate the Service: storing, resizing, watermarking and delivering your photos to the people you share them with. You are responsible for having the necessary rights to the photos you upload, including any people portrayed in them.

5. Selling to your clients

When you sell photos or prints, you are the seller and merchant of record: payments from your clients go to your own Stripe account, and the contract of sale is between you and your client. Photizy is not a party to those sales, takes no commission on them, and is not responsible for the fulfilment of print orders you handle yourself. You are responsible for your own tax and invoicing obligations towards your clients.

6. Acceptable use

You may not use the Service to store or distribute unlawful content, infringe third-party rights, or attempt to disrupt or gain unauthorised access to the Service. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

7. Termination

You can delete your account at any time in the settings; this cancels your subscription and permanently deletes your photos from our storage. We may terminate the Service or your account for material breach of these Terms. Records of completed sales are retained as required by law.

8. Liability

To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect damages, loss of profits, or loss of data beyond our reasonable control. Nothing in these Terms limits liability that cannot be limited under Portuguese law.

9. Changes

We may update these Terms; material changes will be announced by email or in the app with reasonable notice. Continued use after the effective date constitutes acceptance.

10. Governing law

These Terms are governed by Portuguese law. Disputes are subject to the courts of Lisbon, Portugal, without prejudice to mandatory consumer protection rules. Consumers may also use the EU online dispute resolution platform.
